BACK ME BRO COPYRIGHT AND DMCA POLICY

Back Me Bro respects the intellectual property rights of others and expects all users of the Platform (including Creators and Backers) to do the same. We comply with the Digital Millennium Copyright Act (“DMCA”) and other applicable copyright laws.

This Copyright and DMCA Policy applies to all content posted on or through the Back Me Bro Platform, including Campaign descriptions, images, videos, reward details, comments, and any other User Content.

 

Reporting Copyright Infringement (DMCA Notice)

If you believe that any material on the Back Me Bro Platform infringes your copyright, you may submit a notification under the DMCA (17 U.S.C. § 512) to our designated copyright agent. To be effective, your notification must be a written communication (either physical mail or email) that includes all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;

  1. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, the specific URL or Campaign page where the material appears);

  1. Your name, address, telephone number, and email address;

  1. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (e.g., fair use); and

  1. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you are unsure whether material on Back Me Bro infringes on your copyright, please consult with an attorney before filing a DMCA notification.  United States copyright laws require you to consider copyright defenses, limitations, or exceptions, such as the fair use doctrine, before you send a DMCA notice. 

If you misrepresent that material infringes your copyright, you may be subject to liability for damages, including costs and attorneys’ fees incurred by Creators or other parties.  Such misrepresentations may be considered abuse of the DMCA process, and as described below may result in Back Me Bro terminating your User account(s).

 

Our Response to Valid DMCA Notices

Upon receipt of a valid DMCA notice that complies with the requirements above, Back Me Bro will:

  • Expeditiously remove or disable access to the allegedly infringing material;

  • Notify the user who posted the material that it has been removed or disabled;

  • Take reasonable steps to promptly forward the notice to the user who posted the content (when we have their contact information); and

  • Document the notice and our response in accordance with our record-keeping practices.

We reserve the right to remove content that we reasonably believe infringes copyright even in the absence of a formal DMCA notice, and we may do so at our sole discretion.

 

Counter-Notification Procedure

If your content has been removed or disabled in response to a DMCA notice and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. To be effective, your counter-notification must be a written communication that includes all of the following:

  1. Your physical or electronic signature;

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled;

  1. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;

  1. Your name, address, and telephone number; and

  1. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the Federal District Court for the Western District of North Carolina), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and inform them that we will restore the removed material in 10 business days unless we first receive notice that the complainant has filed an action seeking a court order to restrain the infringing activity.

We will restore the material only if we do not receive notice within that period that a lawsuit has been filed.

 

Repeat Infringer & Abuse of DMCA Policy

Back Me Bro has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are repeat infringers of copyright. We may also limit or suspend access to the Platform for users who repeatedly violate this policy or our Terms of Service.

Back Me Bro additionally reserves the right to terminate accounts of any Users abusing the DMCA process or falsely misrepresenting that material infringes their copyright.

  • User Responsibility: By uploading or posting any content on the Platform, you represent and warrant that you own or have the necessary rights, licenses, and permissions to use and authorize Back Me Bro to use that content as described in our Terms of Service. You are solely responsible for ensuring that your content does not infringe the rights of any third party.

  • No Monitoring Obligation: Back Me Bro does not monitor all content posted on the Platform and is not responsible for the content uploaded by users. We act on valid DMCA notices but do not investigate the underlying claims.

  • Limitations on Liability: This policy is intended to comply with the safe harbor provisions of the DMCA (17 U.S.C. § 512). Nothing in this policy limits or affects any other rights or remedies available to Back Me Bro or to copyright owners under applicable law.

Changes to This Policy

We may update this Copyright and DMCA Policy from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Platform after any update constitutes acceptance of the revised policy.
